Programme and Membership Terms and Conditions

  1. Introduction

The Programme is designed to provide you with information, tools, materials and skills to support you in developing as a recovery coach. The membership is designed to provide you with information, tools, materials and skills to support you in developing as a recovery coach as well as developing your recovery coach business.

It is not a substitute for counselling or other therapy services and we are not medical or health practitioners. If you are currently seeking medical or other professional help concerning your mental health, or if you are unsure as to your mental capacity to participate in the Programme or Membership, then you should seek advice from a relevant medical professional and inform us if appropriate and relevant.

1.1 Contents of Programmes

Our programmes typically include:

  • Online exercises and questionnaires

  • Virtual Live learning sessions

  • All manuals and workbooks delivered to your door

  • Registration on the CCAR Training Website

  • CEU’s (continuing education units) that will be recognised through international reciprocity

  1. Application of terms and conditions

    1. These terms and conditions (“Terms”) apply to all training programmes (“Programmes”) and memberships (“Memberships”) operated or offered by Recovery Coach Academy Ltd, Sparkhouse, Ropewalk, Lincoln LN6 7DQ. By registering to be a participant in any of our Programmes or to become a Member you agree to the following Terms and that these prevail over any inconsistent terms or conditions contained, or referred to, elsewhere or as implied by law, trade custom, practice or course of dealing.  

    2. The agreement between us and you, the person or entity registering to be a participant in the Programme and/or a Member (“you”) and which is subject to these Terms (“Contract”), will begin on the date you register, and acknowledge and confirm acceptance and will continue until the Services have been delivered, unless the Agreement is terminated earlier in accordance with these terms or we agree otherwise in writing.

    3. When you register for the Programme and/or Membership you are confirming that you are over 18, that you are legally capable of entering into a legally binding contract and that all information you provide to us is true and accurate.

    4. If you are purchasing online, you should print a copy of these Terms for your records as we will not be filing a copy and we may change these Terms from time to time.

    5. These Terms should be read in conjunction with our Website Terms of Use, and Privacy Policy (all of which can be found on our website www.recoverycoachacademy.co.uk  (“site”)).

    6. Any content posted or submitted by you to our site in the course of the Programme and/or Membership is subject to at all times these terms and conditions.  

    7. Where you are a corporate entity, “you” as used in these Terms shall be deemed to include your officers and employees and you shall procure that such officers and employees fully comply with these Terms.

  2. Programme and Membership

Programme

  1. The Programme will be provided over the course of sessions and shall be delivered by online sessions as detailed on the website.

  2. The date and times of all sessions are as set out on the website but are subject to change. We will provide you with as much notice of any change as is possible, but we shall not be liable to you in any way for any change to such dates or times. Please check the site regularly for updates on changes to dates and times.

Membership

  1. The Membership will be provided online and shall be delivered by online sessions, services and information as detailed on the membership website.

  2. The date and times of all sessions are as set out on the membership site but are subject to change. We will provide you with as much notice of any change as is possible, but we shall not be liable to you in any way for any change to such dates or times. Please check the site regularly for updates on changes to dates and times.

  3.  at all times your behaviour towards others must be polite and respectful and comply with the code of conduct and these terms and conditions. You will not hold us responsible for the behaviour or actions of any other members. Should your behaviour be deemed offensive or inappropriate we reserve the right to remove you from the Membership with immediate effect.

  4. Should you become aware of any inappropriate behaviour, comments or content being shown or displayed within any of our Private Groups or during the delivery of any aspect of the Programme or Membership then you agree to notify us as soon as possible.

  5. Recovery Coach Academy Ltd reserves the right to accept, refuse, or revoke Membership  at our discretion and without being required to state our reason, and without notice.

  6. When you access the Membership, you agree:

  • to be respectful to all members at all times; and

  • not to record any Sessions or Individual Sessions for your personal use or otherwise; and

  • not to share information, whether expressed to be confidential or not, that is shared by another Client; and

  • not to capture or share images of any other Client or that include any other Client without that Client’s express permission; and

  • not to use any Private Group for any unlawful purpose; and

  • that when accessing any Private Group, that you will not upload, post, transmit or otherwise make available content that:

    • is by its nature defamatory, libellous, obscene, demeaning or which causes offence to another individual whether intended or not; or

    • discloses personal and/or confidential or sensitive information about another person; or

    • is threatening or causes us or a Client to feel harassed or in fear; and/or

    • is classed as spam.

    • Where we provide you with access to a private area and you are required to set up an account it shall be your responsibility to:

  • provide the correct information to create your account; and

  • keep your password and any other access information private, safe and secure; and

  • to notify us should you become aware of, or suspect that a third party is aware of your password or other access details.

 

Online Sessions

  1. The online sessions of the Programme and Membership may be held on third party secure servers and we have taken all reasonable steps to ensure that the online content will be available at all times during the course of the Programme and/or Membership but in the event that such content (or any content added by you or other participants in the Programme or Membership) is not available in whole or in part at any time, or becomes corrupted, is deleted or is failed to be stored, we shall have no liability in any circumstances.

  2. You agree to keep user details and your password for the site confidential at all times and to not disclose them to any third party. You must notify us immediately if you become aware of any unauthorised use of your account and you shall indemnify us against all claims, damages, losses, costs or expenses (including professional fees) and any other liability which arises from any unauthorised use of your account.

Cancellation or Changes

  1. You can change the course date to a later date if you can not attend, or the training program registration is transferable to another individual should you choose to withdraw as long as it is done 7 days prior to the start date of the training. Please contact us to discuss.

  2. We understand the training or Membership may not suit everyone, so a refund will be available for cancellations up to the completion of the first lesson, but not after any further lessons of the training program, or up to 14 days from the purchase date, which either occurs first.

  3. Please take this into account when you sign up for a training program or Membership. If you have cancelled within that time frame, and have received training materials, your refund will be less the cost of materials if they are not returned to us in a “good as new” condition.

  4. If you wish to cancel please email [support@recoverycoachacademy.co.uk] stating clearly your wish to cancel and we will provide you with a full refund minus any costs incurred for any printed materials/manuals.

  1. Goods

    1. Where we are providing goods or products (such as Training Manuals, CDs, DVDs or binders) (“Products”) as part of the Programme or Membership or otherwise, the following terms and conditions of this paragraph shall apply.

    2. Any photographs of the Products on our site are for illustration purposes only.

    3. The delivery charges for the Products are as set out on our site from time to time.

    4. Your order will be fulfilled by the estimated delivery date set out in our confirmation email or as described on our site, unless there is an event outside of our control. If we are unable to meet the estimated delivery date because of an event outside our control, we will endeavour to contact you with a revised estimated delivery date.

    5. Delivery will be completed when we deliver the Products to the address you gave us when you placed the order and the Products will be your responsibility from the completion of delivery.

    6. If no one is available at your address to take delivery, we will leave you a note that the Products have been returned to our premises, in which case, please contact us to rearrange delivery. Return delivery will be at your expense.

    7. UK deliveries with a normal delivery time of 1 to 3 days.

    8. International deliveries will take longer. Please allow around 1-3 weeks for delivery to international addresses. Please allow longer for locations that are considered more remote from capital cities. It may be necessary on occasion for you to order manuals and other products directly from Amazon, if this occurs you will be refunded the costs associated with this.

    9. We are not responsible for any customs fees, import duties or taxes incurred for international deliveries outside of the UK. If an order is undeliverable at a destination due to refusal to pay import tax, incorrect address, multiple failed attempts, or otherwise, the order will be returned to us. Reshipping your order will incur an additional shipping surcharge.

    10. Please take into consideration busy holiday periods and weather conditions that may affect and increase shipping times. We do our best to get your order out asap, but delays happen. Please be patient, use the tracking number and contact the carrier if there is an issue.

    11. If your order is showing as 'Delivered' but you have not received your order, please contact us immediately.

    12. You own the Products once we have received payment in full, including all applicable delivery charges.

  2. Payment

    1. Payment is to be made by any method that is detailed on our site from time to time.

    2. Without prejudice to any other right or remedy that we may have, if any sum payable under these terms is not paid within 7 days of the date due we reserve the right to (i) charge interest from the date due for payment to the actual date of payment at the rate of 3% above the base rate of the Bank from time to time in force and/or (ii) suspend the availability of the Programme and/or Membership until such time as payment is made or the Contract is terminated.

    3. The total price payable is exclusive of Value Added Tax (and any other applicable taxes or duties) which shall be added at the applicable rate where necessary.

    4. Unless otherwise stated, all amounts shown on our website are in GBP. The currency and amount will be displayed before you make your payment. We do not store your financial information on our platform.

    5. Our third party service providers, Stripe and Adyen(WIX), will store your details and will use these details for each successive billing period. We are not responsible for your data with Stripe or Adyen.     6. You shall be responsible for all travel, accommodation and other subsistence costs and all other expenses incurred by you in connection with your participation in the Programme or Membership.

    7. All payments are non-refundable other than as set out in paragraph [6.5 and] 8.2 below.

Payment Plans: Terms of the agreement

  1. A “Payment Plan” is an option which allows the participant to stagger their payments for a programme over a set period of time. Once the participant has entered into this form of payment this cannot be cancelled. No refunds are made. This is NOT a Subscription, it is a plan allowing the participant to stagger payments having agreed to the financial contract of a Payment Plan.

  2. The money (detailed on your transaction and receipt) will be paid in a series of payments, via your credit/debit card, as outlined in your transaction, and the specific terms of the agreement.

  3. By purchasing a product with payment plan terms, you hereby authorise Recovery Coach Academy Ltd to charge these instalments to your credit card and further understand and agree: that this payment is non-refundable; not to dispute this charge under any circumstance or in any manner with your bank or any merchant processor; and, that your purchase is subject to the Company’s terms and conditions.

  4. In the event of default of the agreed repayment terms, you accept liability for all costs incurred by Recovery Coach Academy Ltd in recovery due to your breach of the agreed repayment terms. Such costs may include, but not be limited to, a Letter Before Action, Debt Collection Agents fees, Interest and Late Payment Compensation per Invoice of £50.00 + vat. You also acknowledge and agree that a default in payment shall result in the suspension of your access to the course until your account is made current.

  5. If you choose to pay via a Payment Plan option the full course accreditation will only be granted once you have paid your course fees in full. If you default against your payment plan the course fees will need to be paid in full prior to you being re enrolled in the course.

  6. Your payments will be due monthly on the same day as you enrolled. If your payment fails and we need to re apply for your payment a £50 admin fee plus vat may be charged and if your payments is still rejected you will be liable for all outstanding course fees plus an admin fee of £50.00 within 7 days from the date the final attempt to take your payment is rejected.

  7. This admin fee covers all admin incurred by the debt excluding legal costs. This may be claimed additionally

  8. We reserve the right to apply admin fees to your account for the time spent in letters and emails whilst trying to reclaim outstanding course fees.

  9. We would always recommend you talk any financial problems through with us as we will offer as much support as we can within the terms of our terms of business. If in any doubt please contact us on support@recoverycoachacademy.co.uk to discuss before committing to any financial commitments prior to committing to any of our Programmes or memberships.

  1. Our obligations

    1. We warrant to you that the Programme and Membership, and Programme and Membership materials purchased from us are of satisfactory quality and reasonably fit for the purpose for which the Programme and/or Membership is supplied. 

    2. Other than as set out in paragraph 6.1 above, all warranties and representations are excluded to the fullest extent permitted by law. Due to the nature of coaching and the fact that your success is dependent on a number of factors over which we have no control, we do not guarantee any particular results.

    3. We will endeavour to ensure that all information that we provide is accurate and up-to-date but we shall not be liable for any claims arising from such information being inaccurate or not up-to-date or otherwise.

    4. We acknowledge that in the course of the Programme and/or Membership we will have access to your confidential information and we agree not to (except in the proper course of our duties) use or disclose to any third party such confidential information. This restriction does not apply to:

(a)any use or disclosure authorised by you or required by law;

(b)any use or disclosure which we in our absolute discretion consider necessary or advisable in order to prevent illegal acts or harm to you or to others; or

(c)any information which is already in, or comes into, the public domain otherwise than through our unauthorised disclosure.

Provided that we have not begin to perform the Contract you may cancel the Contract within 14 days of the date of you registering for the Programme or Membership by emailing us at support@recoverycoachacademy.co.uk  stating your clear intention to cancel or by using the form of cancellation annexed to this agreement at Annex 1. If we receive such email within 14 days of the date of you registering for the Programme and/or Membership, we shall provide you with a full refund of the amount paid by you up to such date, within 14 days of the day on which we received your valid notice of cancellation and usually by the method originally used by you to pay for your purchase minus any costs incurred for any printed materials/manuals.

  1. You hereby request immediate performance of the Contract and acknowledge that you will lose your right of withdrawal from the Contract once the service contract is fully performed. If you cancel the Contract before the services have been fully performed, you agree that you will pay for the supply of the service for the period for which they are supplied. The amount payable will be in proportion to what has been supplied, in comparison with the full coverage of the Contract.

  2. You agree that we may begin the supply of digital content not on a tangible medium before the end of the cancellation period set out in paragraph 6.4 above and you acknowledge that you will lose your cancellation rights in relation to such digital content.

  3. You acknowledge and agree that your personal data will be processed by and on behalf of us as part of us providing the Programme and/or membership to you.

  1. Intellectual Property

    1. We are the owner or the licensee of all Intellectual Property Rights and all other rights in the Programme and Membership and all content within the Programme and/or Membership and nothing in these Terms or otherwise shall operate to transfer the ownership of the Intellectual Property Rights in the Programme or Membership or the content of the Programme or membership to you or to any other person.

    2. You may not at any time copy, reproduce, publish in any form, share, sell, dispose of or otherwise make available to a third party in any way any of the content or materials contained in the Programme or Membership.

    3. We grant to you a limited, non-exclusive, non-transferable, non-sub licensable revocable licence to use all or any of the content of the Programme and Membership for the purposes for which the Programme and Membership were provided only.

    4. Except as set out in paragraph 7.3, you may not use any of our intellectual property rights at any time except where duly licensed. Use of our logo is strictly prohibited without our prior written consent.

    5. You may not without our prior written consent make any audio or visual recordings of any part of our Programme or membership.

    6. We may from time to time record the Programme or membership being delivered during your attendance.  You authorise us to use your image and voice in any such recordings without payment, other condition or need for further consent.

    7. You acknowledge that certain information contained in the Programme and membership and supplied materials is already in the public domain.

    8. You are not permitted to sell or promote products or services to other participants in the Programme or membership at or during any part of our Programme or membership without our prior written permission.

    9. The provisions of this paragraph 7 shall survive termination of the Contract.

  2. Term and termination

    1. The Contract shall continue until the end of the Programme or Membership when the Contract shall expire other than for the Terms that are specifically stated to remain in force.

    2. Notwithstanding the provisions of paragraph 8.1, either of us may terminate the Contract on written notice to the other with immediate effect if at any time:

      1. The other commits any serious or repeated breach or non-observance of any of the provisions of these Terms; or

      2. The other (i) makes a resolution for its winding up, (ii) makes an arrangement or composition with its creditors, (iii) makes an application to a court of competent jurisdiction for protection from its creditors, (iv) is unable to pay its debts, (v) ceases trading or an administration or winding-up order is made or an administrator or receiver is appointed in relation to such party, (vi) is declared bankrupt or (vii) is convicted of a custodial offence (other than a road traffic offence); or

      3. The other party commits any fraud or dishonesty or acts in any manner which in the opinion of the terminating party brings or is likely to bring the terminating party into disrepute or is adverse to the interests of the terminating party.

    3. On or before the date of termination of the Contract, you shall immediately pay any unpaid fees or other sums payable under these Terms (which for the avoidance of doubt shall include any remaining instalments regardless of the point at which the Contract is terminated).

    4. Termination of this agreement shall not affect either of our accrued rights, remedies, obligations and liabilities of either of us as at the date of termination of this Contract, including the right to claim damages in respect of any breach of the Contract which existed at or before the date of termination.

    5. Any delay by us in exercising our right to terminate the Contract shall not constitute a waiver of our right to terminate or to seek any other remedy.

    6. Paragraphs which expressly or by implication have effect after termination of the Contract shall continue in full force and effect after the date of termination of the Contract.

    7. This paragraph 8 shall survive termination of the Contract.

    8. Where the Contract expires, this shall be treated as a termination for the purposes of paragraph 8.7 and all other paragraphs that refer to “termination”.

  3. Liability

    1. Nothing in this paragraph 9 shall limit our liability for death or personal injury caused by our negligence or for our fraud or fraudulent misrepresentation or for any matter for which liability cannot be legally excluded or limited.

    2. We shall not be liable for any loss of profits, loss of business, depletion of goodwill and/or similar losses, loss of anticipated savings, loss of goods, loss of contract, loss of corruption of data or information or any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses suffered or incurred by the you as a result of you entering into the Contract and/or us providing the Programme or Membership.

    3. Our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the performance or contemplated performance of the Contract shall in all circumstances be limited to the price paid by you for the Programme or membership.

    4. If we are prevented from or delayed in performing our obligations by your act or omission or by any circumstance outside of our control, we shall not be liable to you for any costs, charges or losses sustained or incurred by you that arise directly or indirectly from such prevention or delay.

    5. We shall not be not liable for additional costs incurred by you as a result of changes in (i) the Programme or Membership, (ii) any other content, (iii) the location of venues, (iv) the time and date of sessions or (v) trainers, instructors or coaches.

    6. The provisions of this paragraph 9 shall survive termination of the Contract.

    7. You acknowledge and agree that:

      1. The Contract constitutes the entire agreement and understanding between us and supersedes any previous arrangement, understanding or agreement between us relating to the provision of the Programme and/or Membership (which shall be deemed to have been terminated by mutual consent);

      2. in entering into the Contract, you have not relied on any undertaking, promise, assurance, statement, representation, warranty or understanding (whether in writing or not) of any person (whether party to the Contract or not) relating to the provision of the Programme or Membership other than as expressly set out in the Contract.

  4. No Guarantee

    1. When purchasing the Programme and/or Membership you will have access to the Services, Content, people and support all designed to benefit you but it is your responsibility to take action and to implement the necessary information received and/ or the skills or tools shared. Your success and any results are dependent on factors which are outside of our control and we regret that we are not able to guarantee that any particular results or success will be achieved.

    2. We have made every effort to accurately represent the Programme and the Membership.  Any testimonials and/or examples of results experienced are not intended to represent or guarantee that anyone will achieve the same or similar results. As with any business endeavour, there is an inherent risk of loss of capital and we make no guarantee, representation or warranty with respect to the Programme, Membership or the Services provided.

  5. General

    1. By registering for our Programme and/or Membership you warrant that:

      1. You are legally capable of entering into binding contracts; and

      2. You are at least 18 years old; and

      3. That all information you provide us with is materially true and accurate at all times and not misleading in any way.

    2. You accept that communication with us will be mainly electronic.  We will contact you by e-mail or provide you with information by posting notices on our site.  You agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing.  This condition does not affect your statutory rights.

    3. We may vary these Terms (other than the price payable by you for the Programme and/or membership) as we see fit from time to time and if we do, we shall notify you by email of the change of terms. Your continuation with the Programme or membership will be deemed to be your acceptance of any new Terms.

    4. The Contract is personal to you and you may not assign, transfer, charge, subcontract, sub-license or deal in any other manner with all or any of your rights under the Contract.

    5. We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.

    6. If we fail to insist upon strict performance of any of your obligations under the Contract, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. A waiver by us of any default shall not constitute a waiver of any subsequent default. No waiver by us of any of these Terms shall be effective unless it is expressly stated to be a waiver and is in writing.

    7. If any of these Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

    8. A person who is not a party to the Contract shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Contract.

    9. The rights of the parties to terminate, rescind or agree any variation, waiver or settlement under the Contract are not subject to the consent of any person that is not a party to the Contract.

    10. The Contract and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with English law.

    11. We each irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with the Contract or its subject matter or formation (including non-contractual disputes or claims).

    12. Unless the context otherwise requires, a reference to one gender shall include a reference to the other gender.

Medical Disclaimer

Any information or guidance we provide is not a substitute for the consultation, diagnosis, and/or medical treatment of your doctor or healthcare provider.

 

You must not rely on any information or guidance we provide you with as an alternative to medical advice from your doctor or healthcare provide and we expressly disclaim all responsibility, and shall have no liability, for any damages, loss, injury, or liability whatsoever suffered by you or any third party as a result of your reliance on any information or guidance we provide you with.

 

If you have any specific questions or concerns about any medical matter, you should consult your doctor or healthcare provider as soon as possible.

 

If you think you may be suffering from any medical condition, you should seek immediate medical attention from your healthcare provider. Do not delay seeking medical advice, disregard medical advice or discontinue medical treatment because of information or guidance we provide you with.

 

Nothing in this disclaimer will limit or exclude any liability that may not be limited or excluded by applicable law.

Release and Disclaimer

You agree that you are participating in Recovery Coach Academy Training at your own risk and that we/I shall not be liable under any circumstances for any matter arising out of your participation (other than for matters for which we are/I am not legally able to exclude or limit liability such as death or personal injury caused by our negligence or fraudulent misrepresentation).

Due to the nature of coaching, we/I do not guarantee any particular result. We/I will endeavour to ensure that all information that we/I provide is accurate and up-to-date but we/I shall not be liable for any claims arising from such information being inaccurate or not up-to-date or otherwise.
